Yuma User Agreement

Agreement to use the app

Effective date: April 12, 2026
This document governs your use of the Yuma mobile application and related on-device experiences. It is a user agreement setting out the rules that apply between you and the operator of Yuma; it is not labeled or presented as a standalone “terms of sale” for physical goods.

1. Who we are

“Yuma,” “we,” “us,” and “our” refer to the operator of the Yuma application made available for compatible iPhone devices. Contact details appear in Section 16. This User Agreement forms a binding contract between you and us when you download, install, access, or use Yuma.

2. The Yuma product

Yuma is a photo-driven creative playground: you can import images from your photo library as luminous cards, arrange them in an interactive “energy field,” compress and resonate them into visual effects, save outputs, and browse archives on your device. Features may evolve by version; descriptions in the App Store listing or in-app “About” screen summarize the current experience.

Yuma is intended for personal, non-commercial entertainment and creative experimentation unless we expressly authorize otherwise in writing.

3. Eligibility

You must be old enough to form a binding contract where you live and meet any minimum age required by Apple’s platform rules and applicable law to use Yuma and to make in-app purchases. If you use Yuma on behalf of an organization, you represent that you have authority to bind that organization.

4. License & restrictions

Subject to this User Agreement and the Apple Media Services Terms (or equivalent terms presented by Apple for your App Store account), we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Yuma on Apple-branded devices that you own or control.

You must not:

  • Copy, modify, distribute, sell, lease, or reverse engineer Yuma except as permitted by mandatory law;
  • Remove or alter proprietary notices or branding;
  • Use Yuma to build a competing product, to scrape or overload our systems, or to violate law or third-party rights;
  • Circumvent technical limits, payment flows, or security measures.

5. Your photos & content

You are responsible for photos and other content you import or generate with Yuma. You represent that you have the rights needed to use that content. Processing is designed to occur on your device for core creative workflows; see our Privacy Policy for how data may be handled, including any permissions you grant (for example, photo library or device capabilities).

We do not claim ownership of your original photos. Outputs you create may be subject to license terms of underlying system components where applicable; you are responsible for how you share or publish your exports.

6. Virtual currency & in-app purchases

Yuma may offer virtual coins or similar digital balances used to unlock premium interactions inside the app. Virtual currency has no real-world monetary value outside the app, is non-redeemable for cash except where required by law, and is licensed as part of your use of Yuma.

Purchases are processed by Apple. Pricing, taxes, and refund rights follow Apple’s policies and applicable consumer laws in your region. If a transaction is reversed or invalidated, we may adjust or revoke associated virtual currency or entitlements.

Nothing in this User Agreement is intended to override mandatory consumer rights in your country or state regarding digital content or faulty performance.

7. Privacy & tracking

Our collection and use of personal information are described in the Privacy Policy, including choices you may have under California, Canadian, Singapore, Australian, and other applicable frameworks. If the app requests App Tracking Transparency consent, your choice controls whether certain identifiers may be used for tracking as defined by Apple.

8. Acceptable use

You agree not to use Yuma to:

  • Harass, defraud, or harm others;
  • Upload or process unlawful content (including content that infringes intellectual property or privacy rights);
  • Interfere with the integrity or performance of the app or other users’ devices;
  • Violate export control, sanctions, or other applicable regulations.

9. Intellectual property

Yuma, its name, logos, UI design, and underlying software are protected by intellectual property laws. Except for the limited license in Section 4, no rights are granted to you. Feedback you provide may be used by us without restriction or compensation, subject to applicable privacy law.

10. Disclaimers

To the maximum extent permitted by applicable law, Yuma is provided “as is” and “as available.” We disclaim implied warranties such as merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation or that outputs will meet your artistic or commercial expectations.

11. Limitation of liability

To the maximum extent permitted by applicable law, we and our affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from or related to your use of Yuma.

Our aggregate liability for claims arising out of or related to this User Agreement or Yuma shall not exceed the greater of (a) the amount you paid us directly for Yuma in the twelve (12) months before the claim (excluding amounts paid to Apple for in-app purchases, which are governed by Apple’s terms) or (b) fifty U.S. dollars (USD 50), except where such a cap is prohibited (for example, for death or personal injury caused by negligence, fraud, or other non-waivable rights).

Apple

If you obtained Yuma from the Apple App Store, you acknowledge that Apple is not responsible for Yuma or its content, maintenance, or support, and Apple has no obligation to furnish any maintenance or support services with respect to Yuma. Apple is a third-party beneficiary of this User Agreement solely for purposes of enforcing these provisions as required by Apple’s guidelines.

12. Indemnity

You will defend, indemnify, and hold harmless the operator of Yuma and its affiliates, officers, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your content, your misuse of Yuma, or your violation of this User Agreement or law, except to the extent caused by our willful misconduct.

13. Suspension & termination

We may suspend or terminate access to Yuma if you materially breach this User Agreement or if we discontinue the service where permitted. You may stop using Yuma at any time by uninstalling it. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and regional consumer rights) will survive termination.

14. Regional consumer notices

Laws in California (United States), Canada, Singapore, Australia, and other regions may give you rights that cannot be waived. If you reside in:

California, USA

California residents may have specific rights under the California Consumer Privacy Act (CCPA), as amended by the CPRA, regarding personal information. See our Privacy Policy for privacy requests. Certain warranty disclaimers may not apply to the extent prohibited by California Civil Code Section 1789 et seq.; the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Canada

If you are a consumer in Canada, this User Agreement does not limit any rights or remedies under the Consumer Protection Act of your province or territory or under privacy statutes such as PIPEDA, where applicable.

Singapore

If you are in Singapore, nothing in this User Agreement excludes or restricts liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable mandatory consumer protection or contract law in Singapore.

Australia

If you are in Australia, our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You may be entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

Governing law & disputes

Except where mandatory local law requires otherwise, this User Agreement is governed by the laws of the State of California, USA, without regard to conflict-of-law rules, and the courts located in San Francisco County, California, shall have non-exclusive jurisdiction, subject to any right you may have to bring proceedings in your home courts as a consumer.

15. Changes

We may update this User Agreement from time to time. We will post the revised version with a new effective date in the app or linked materials where practicable. Continued use after the effective date constitutes acceptance of the updated agreement, except where your prior express consent is required by law.
